Patent

According to the Egyptian IP law A patent shall be granted to any industrially applicable invention, which is new, involves an inventive step, whether connected with new industrial products, new industrial processes, or a new application of known industrial processes.

The patent is also granted, independently, for any modification, improvement or addition to a previously patented invention, which meets the criteria of being new, inventive and industrially applicable, as stated in the preceding paragraph. The Patent should to be registered before the Egyptian Patent Office in order to enjoy with the full protection including the criminal protection.

The protection period a patent shall be 20 years as of the date of filing the application in Egypt

The legal requirements for filling PCT application for the Egyptian national phase:

  1. A Power of Attorney duly legalized up to the Egyptian consulate.(as per form attached). Please note that we may proceed with filing the application without the power of attorney. However the legalized P.O.A should to be submitted before the Egyptian patent Office within 4 months from the filling date.
  2. A copy of the specification, claims, drawings, and abstract by English.
  3. 3- A copy of the specification (including claims, drawings, and abstract) in Arabic. Please note that such translation should to be submitted within six months from the filing date.
  4. The number and date of the PCT application filed

The requirements for filing patent application in Egypt.

  1. A Power of Attorney duly legalized up to the Egyptian Consulate as per form attached (please note that we may proceed with filing the patent application without the legalized Power of Attorney which should to be submitted within six months from the filing date).
  2. An extract of a commercial register or certificate of incorporation legalized up to the Egyptian Consulate (if the applicant not individual).
  3. A Deed of Assignment legalized up to the Egyptian Consulate.
  4. A certified copy of the priority application with an English translation thereof, both legalized up to the Egyptian Consulate.
  5. A copy of the specification including claims, drawings, and abstract in Arabic
